This Privacy Policy ("Policy") outlines how SURGETALENTS HR CONSULTING PTE. LTD. ("we", "us", "our"), the company behind the PEOP-powered Surge platform, collects, uses, discloses, and protects your personal data in accordance with the Personal Data Protection Act 2012 (PDPA) of Singapore. This Policy applies to all individuals who access or use Surge (the "Service", "Software", "Platform"), including clients ("Client") and users ("User").

By using the Service, you consent to the practices described in this Policy. If you do not agree with these practices, you must not use the Service.

2. Types of Personal Data We Collect

We may collect and process the following types of personal data, including but not limited to:

  • Personal Identification Information:
    • Name
    • Email address
    • Phone number
    • Job title
    • ID Number (not mandatory)
    • Any other personal identification info including address.
  • Account Information: Username, password, and other registration details necessary to access the platform.
  • Employee Data: For Client accounts, employee records, profiles, and other HR-related information uploaded by the Client or its users.
  • Usage Data: Information about how the Service is used, including IP addresses, browser types, and browsing behavior within the platform.

3. Purpose of Data Collection

We collect and process personal data for the following purposes:

  • To Provide the Service: To enable you to register, access, and use the Service, and to provide necessary support.
  • To Improve the Service: To analyze usage patterns, develop new features, and improve functionality.
  • Communication: To respond to inquiries, provide customer support, and send important updates related to the Service, including changes to the Terms and Conditions or this Privacy Policy.
  • Compliance: To fulfill legal obligations and comply with applicable regulations, including those under the PDPA.

For terminated accounts, personal data may be retained for up to 60 days before being deleted, unless otherwise agreed upon with the Client.

However, please be aware that no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security of your personal data.

Under the PDPA, you have the following rights regarding your personal data:

  • Access: You may request to access the personal data we hold about you.
  • Correction: You may request to correct any inaccurate or incomplete personal data.
  • Withdrawal of Consent: You may withdraw your consent for us to process your personal data, subject to legal and contractual restrictions. This may result in limitations to your use of the Service.
  • Request for Deletion: You may request the deletion of your personal data, subject to retention requirements under law.

10. Additional Non-Disclosure for Demo or Trial Access (New)

If your organization or team receives access to Surge for demonstration, evaluation, internal preview, or trial purposes (“Demo Access”), the following additional confidentiality rules apply:

  • All system functionalities, visual elements, workflows, and proprietary business logic observed during Demo Access are considered confidential and must not be disclosed to any external party.

  • No part of the platform, its processes, or documentation may be shared, copied, reverse-engineered, or reproduced in any form without prior written approval from SURGETALENTS HR CONSULTING PTE. LTD.

  • This non-disclosure obligation remains binding even if the recipient decides not to proceed with a subscription or commercial engagement.

This clause supplements the Confidentiality section in our Terms and Conditions.

11. Changes to This Privacy Policy

We reserve the right to modify or update this Privacy Policy at any time. Any changes will be communicated via email or through the Service. Continued use of the Service after such changes constitutes your acceptance of the updated Policy.
